1. ABOUT US

The Pink Socialite is a business registered with the Chamber of Commerce in Amsterdam, The Netherlands.

The Review Concierge is a service name and sub-brand operated by The Pink Socialite. All services provided under The Review Concierge fall under these same Terms & Conditions and legal entity.

These Terms apply to all websites, platforms, software, automations, review services, consulting, messaging systems, and related services provided by The Pink Socialite (collectively, the “Services”).

By using our Services, you agree to these Terms. If you do not agree, you must not use the Services.

2. SCOPE OF SERVICES

The Pink Socialite provides digital marketing, automation, and reputation-related services, including but not limited to:

  • CRM setup and automation

  • AI-driven workflows and integrations

  • Email, SMS, WhatsApp, and messaging systems

  • Funnel setup and optimization

  • Review request systems and review management services (The Reputation Concierge)

  • Review monitoring, response support, and review content repurposing (where applicable)

  • Consulting, implementation, and managed services

We provide tools, systems, and execution support.
We do not guarantee results, including but not limited to:

  • Number of reviews

  • Review ratings or sentiment

  • Removal of negative reviews

  • Increased revenue, leads, or reputation improvement

3. ELIGIBILITY

You must be at least 18 years old and legally authorized to enter into agreements.

If acting on behalf of a business, you confirm you are authorized to bind that business.

4. ACCOUNT & ACCESS RESPONSIBILITY

You are responsible for:

  • All activity under your account

  • Keeping login credentials secure

  • Actions taken by employees, contractors, or third parties using your access

We may suspend or terminate access if misuse, abuse, or legal risk is identified.

5. INTELLECTUAL PROPERTY

All software, workflows, templates, scripts, dashboards, messaging frameworks, review systems, branding, and documentation provided by The Pink Socialite (including The Reputation Concierge) remain our intellectual property unless explicitly agreed otherwise in writing.

You receive a limited, non-transferable, revocable license to use deliverables internally for your business.

You may not:

  • Copy, resell, sublicense, or redistribute our systems

  • Reverse engineer or replicate our workflows

  • Use our materials to build competing services

6. CLIENT CONTENT & DATA

If you provide content, customer data, reviews, or feedback:

  • You confirm you have the legal right and consent to provide it

  • You remain the data controller

  • You authorize us to process the data solely to deliver the Services

Feedback or suggestions you submit may be used by The Pink Socialite without compensation.

7. PAYMENTS & SUBSCRIPTIONS

  • Fees are payable upfront unless agreed otherwise

  • Subscriptions renew automatically unless canceled

  • Prices may change with notice

  • No refunds for partial use, unused time, or early cancellation

Non-payment may result in suspension or termination.

8. REVIEW SERVICES (THE REPUTATION CONCIERGE)

When using The Review Concierge services, you acknowledge that:

  • Reviews are written by real customers, not The Pink Socialite

  • We do not control what customers write or whether they leave a review

  • We cannot guarantee positive reviews or review volume

  • Negative reviews are a possible and inherent risk

If review response support or management is provided:

  • Responses may be based on templates or client-approved guidelines

  • Final responsibility for tone, accuracy, and compliance remains with the client

9. MESSAGING & AUTOMATION AUTHORIZATION

By using our Services, you authorize The Pink Socialite to send messages (email, SMS, WhatsApp, etc.) on your behalf, including review requests under The Review Concierge.

  • Messages may appear under your business name

  • Default templates are deemed approved unless modified

  • You control content, frequency, and recipients

We act solely as a technical and operational service provider.

10. CONSENT & LEGAL COMPLIANCE (CLIENT RESPONSIBILITY)

You are solely responsible for:

  • Obtaining valid, explicit consent from all contacts

  • Complying with all applicable laws (GDPR, TCPA, CAN-SPAM, CCPA, CASL, and others)

  • Respecting opt-outs and do-not-contact requests

  • Ensuring customer data was collected lawfully

If a legal claim arises due to lack of consent or misuse, liability rests entirely with you.

11. THIRD-PARTY PLATFORMS

Our Services may rely on or integrate with third-party platforms (Google, Meta, CRMs, SMS providers, email providers, review platforms).

  • We do not control these platforms

  • Outages, policy changes, or restrictions are outside our control

  • We are not liable for third-party failures

12. NO GUARANTEES & DISCLAIMER

All Services are provided “as is” and “as available.”

We make no warranties regarding:

  • Performance

  • Results

  • Availability

  • Error-free operation

  • Compliance outcomes

Use of the Services is at your own risk.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • We are not liable for indirect or consequential damages

  • Total liability is limited to the amount paid by you in the 30 days prior to the claim, capped at €500

14. INDEMNIFICATION

You agree to indemnify and hold harmless The Pink Socialite from any claims, fines, damages, or legal costs arising from:

  • Messaging without proper consent

  • Data privacy violations

  • Review-related disputes

  • Content or data you provide

  • Misuse of the Services

This obligation survives termination.

15. TERMINATION

You may cancel according to your subscription or agreement terms.

We may suspend or terminate Services immediately if:

  • Payment is overdue

  • Legal or compliance risk exists

  • The Services are misused

  • Required by law or authorities

No refunds apply where termination is due to violations.

16. DATA RETENTION & DELETION

We may retain account data after cancellation for operational or legal reasons.

You may request permanent deletion in writing. We will comply within a reasonable timeframe, subject to legal obligations.

17. GOVERNING LAW

These Terms are governed by the laws of The Netherlands.

Any disputes will be handled by the competent courts in the Netherlands.

18. MODIFICATIONS

We may update these Terms at any time. Continued use after changes constitutes acceptance.
